Terms of Service

These Terms govern your use of Provia, an AI-powered sales platform for store owners on Instagram, Facebook Messenger, and the web. By creating an account or connecting a store, you agree to these Terms. If you do not agree, do not use Provia.

Provia is currently operated by Ali M. Afana. References to “Provia,” “we,” or “us” in these Terms mean the operator. References to “you” mean the store owner who holds the Provia account.

1. The service

Provia lets you configure an AI sales assistant for your store, connect your product catalog, and let the assistant chat with your customers on Instagram, Facebook Messenger, and the web. Provia handles message routing, AI-generated replies, semantic product search, and basic lead management.

Provia is provided on an “as is” basis. Features may be added, changed, or removed. Provia may impose usage limits to keep the service running for all users.

2. Eligibility

You must be at least 18 years old and legally able to enter contracts in your jurisdiction. If you use Provia on behalf of a business, you confirm you have the authority to bind that business to these Terms.

3. Your account and your store

  • You are responsible for everything that happens under your account, including the words your AI bot says on your behalf to your customers.
  • You must provide accurate store information (name, country, language, products, prices, policies). Provia's AI uses this information to talk to your customers.
  • You must keep your account credentials secure. Notify us if you suspect unauthorized access.
  • You may not share or resell access to your account.

4. Acceptable use

You agree not to use Provia to:

  • Sell or promote illegal goods, weapons, illegal drugs, or any product prohibited by Meta's Commerce Policies or Community Standards.
  • Send spam, harass customers, or contact people who have not interacted with your store.
  • Misrepresent stock, prices, or product attributes to customers.
  • Impersonate another business, brand, or person.
  • Attempt to bypass rate limits, security controls, or per-tenant data isolation.
  • Reverse-engineer the platform, scrape data not belonging to you, or interfere with normal operation.

Provia may suspend or terminate accounts that violate these rules, with or without prior notice, depending on the severity.

5. Customer communications

When a customer chats with your Provia store, the customer is communicating with you — not with Provia. You are responsible for honoring the commitments your AI bot makes on your behalf (prices quoted, policies described, products promised). Provia's AI is configured by you and speaks in your store's voice; you are the merchant of record.

6. Pricing and payment

Provia is currently in a free pre-launch period. When paid plans launch, pricing and billing terms will be published on Provia's pricing page and you will be given at least 30 days' notice before any plan you are on becomes a paid plan. Continued use after the notice period constitutes acceptance of the new terms.

7. Intellectual property

  • Your content — your store name, product catalog, product images, prices, and configuration belong to you. You grant Provia a non-exclusive license to host, process, and display this content as needed to operate the service.
  • AI-generated text — the messages the AI generates in your store's voice belong to you. Provia does not claim ownership of bot replies.
  • The platform — Provia's code, design, copy, and brand belong to Provia. Use of the service does not grant you any right to the platform itself.

8. Termination

You may terminate your account at any time by emailing aliafana@smail.ucas.edu.ps. Provia may terminate or suspend access for breach of these Terms, prolonged inactivity, or in response to a legal requirement. On termination, your data is deleted within 30 days unless retention is required by law.

9. Disclaimers

Provia is provided “as is” and “as available.” To the maximum extent permitted by law, Provia disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-generated replies may contain errors. You are responsible for reviewing your store's configuration, your product data, and any commitments the AI makes on your behalf.

10. Limitation of liability

To the maximum extent permitted by law, Provia will not be liable for indirect, incidental, consequential, special, or punitive damages, or for any loss of profits or revenues, arising from your use of the service. Provia's total liability for any claim related to the service is limited to the amount you have paid to Provia in the twelve months preceding the claim, or USD $100, whichever is greater.

11. Indemnification

You agree to defend and indemnify Provia against claims, damages, and costs arising from your use of the service, your content, or your violation of these Terms — including claims from your own customers about the commitments your AI bot made on your behalf.

12. Governing law

These Terms are governed by the laws of Palestine, without regard to conflict of law principles. Disputes will be resolved in the courts of Palestine, unless required otherwise by mandatory consumer-protection law in your jurisdiction.

13. Changes to these Terms

Provia may update these Terms as the product evolves. Material changes will be announced to active account holders by email at least 30 days before they take effect. Continued use after the notice period constitutes acceptance.
